Woman in Iowa car chase recounts odd tale Having smoked some "rock" a short time earlier, the suspect in a high-speed July 11 Iowa police chase reacted to an officer shooting at him by reaching for more drugs as he raced through Iowa City streets, his passenger claims.
In a witness statement to the Johnson County, Iowa Sheriff's Department, Clydtie L. Nunez said she did not know Christopher K. Oaks before getting in the car and that she, "didn't want no part of it (the chase)."

Iowa Police released the statement Tuesday. "Rock" commonly refers to methamphetamine or crack cocaine.

Oaks, 32, of Burlington, Iowa is accused of stealing a black 2002 Chevrolet Impala in Tipton. Nunez said he asked her to go for a ride in his new car before leading authorities on the chase into Iowa City.

Nunez's statement corroborates police reports that the car swerved toward Officer David Droll before he fired one shot at the driver's side wheel.

"Then I saw a cop shot at the tire, and I told him to stop," Nunez said in the statement. "He almost ran that cop over, he said he didn't see him."

An internal Iowa Police Department review committee used Nunez's statement, other witness reports, audio and video tapes, police and sheriff reports, department policies, Iowa state law and Emergency Communications Center data to evaluate Droll's decision to use deadly force.

On Monday, Iowa Police Chief R.J. Winkelhake said the committee concluded Droll had reason to fear for his life, and was justified in using his weapon.

"The officer saw the driver and passenger in the vehicle, and in this incident the officer elected to fire his weapon at the wheel in an effort to disable the vehicle," Winkelhake said in the report issued Monday.

Nunez said she first met Oaks outside her apartment, and after offering him a Mountain Dew and smoking some "rock," she agreed to go with him to Cedar Rapids.

"... he asked me if I wanted to smoke some rock, I said sure, I smoke a half a one and he smoke 11/2 ...," she said in the statement. "... then we went downstairs. I said nice car, he said he came with some money and he bought today."

After leaving Nunez's apartment, she said they stopped to get $10 in gas and then decided to go to the Coralville Lake. The Sheriff's Department received the report of a stolen vehicle at 3:57 p.m. and began following the vehicle south on Dubuque Street, officials said.

"But we I saw the first cop ask him to stop, he said no..." she said in the statement. "I ask what is going on, he said will tell the truth, the car he stold it and I asked him to let out. I didn't want no part of it."

County deputies radioed the Iowa City Police Department for assistance at 4:08 p.m., and Droll put stop sticks across Prairie du Chein Road.

After Oaks drove through several yards to avoid the sticks, Droll fired a shot at the vehicle in an effort to defend himself and end the pursuit.

According to police reports, the bullet hit the tire rim, and Oaks continued the chase heading the wrong way on Governor Street.

"Then he another rock out of his pocket and that did it," Nunez said in the statement. "I going to smoke, I'm going to jail anyway."

Nunez said as the chase ensued and law enforcement closed in on the pair, she began screaming at Oaks to let her out.

"I was scared," she said. "When I tried to get out he keep hitting me and saying not yet. He told me his name was Joe. I'm so glad it's all over."

Nunez could not be reached for comment Tuesday. She has not been charged with any crime. Oaks was arrested for eluding law enforcement, several traffic violations and first-degree theft. Officials are considering pressing additional charges.
