Ex-Davenport officer pushes to strengthen Iowa meth lawDES MOINES, Iowa — A group of Iowa lawmakers is pushing a bill that puts new teeth into a law that punishes parents for allowing their children to be present in homes where methamphetamine or other drugs are being manufactured.

Rep. Jim Van Fossen, R-Davenport, Iowa a retired police officer, is sponsoring the bill that would elevate the child endangerment charge from an aggravated misdemeanor to a Class D felony. Those charged could face a five-year prison term.

Van Fossen said he has seen instances where children were taken to the emergency room for treatment after being exposed to chemicals used in making meth.

The children in those situations also face a number of other problems, he said.

“I’ve seen where the children are being neglected, not cared for physically, they’re not going to school, the residences are terrible and all these dangerous drugs are lying around,” he said.

Parents or caretakers who are not directly involved in the manufacturing of the drug also could face the enhanced child endangerment charge if they knowingly allow their children to be exposed to the manufacturing of drugs or the presence of precursor ingredients.

Van Fossen said it would put parents who live with someone involved in the drug trade on notice that they could be charged with a crime if they do not take their children out of the situation.

A number of law enforcement groups and the Iowa County Attorneys Association are supporting the bill.
.
But the Iowa Civil Liberties Union, or ICLU, is lobbying against the legislation, saying it amounts to overkill in situations where people charged with drug manufacturing already are facing long prison sentences.

“We’re incarcerating people instead of giving them help,” said Iowa Civil Liberties Union lobbyist Marty Ryan, who rejects the idea that it would be a deterrent. Drug Rehab by County
